3 25-03-2014 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The two petitioners are apprehending their arrest in connection with a case registered for the offence punishable under Sections 364A, 365, 387 of the Indian Penal Code,

This case is of the year 1993 instituted against two unknown and several unknown, petitioner’s name appear emerging during investigation and police already submitted charge-sheet showing them absconder.

Submission is of false implication, no material against them. Further, at no point of time, any notice was ever served upon these two petitioners who carry no criminal antecedent.

If, it is so , considering the facts and circumstances of the case, in the event of their

arrest/surrender before the court below within four weeks, let the above named petitioners be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri P.Krishna, Judicial Magistrate, 1^st Class, Bagaha, West Champaran, in connection with Trial No. 1214/2013 arising out of Dhanaha P.S. Case No. 43/1993 , subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with additional condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
