JUSTICE AKHILESH CHANDRA ORAL ORDER 2 24-03-2014 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner, apprehending his arrest in connection with a case registered for the offence punishable under Sections 47, 49, 55 and 58 of the Excise Act, is one of the named accused in this case of the year 2003, wherein, the prosecution report was submitted in the year 2003 itself, but cognizance has been taken only on 01^st June, 2012.

Submission is of false implication under some confusion. In fact, the plot in question was though allotted to the petitioner much before but since it was under encroachment by earlier allottee against whom due orders were subsequently passed and, vide Annexure-5, in the year 2012 itself valid papers and possession has been given to the petitioner after deposit of due amount. Further, he carries no criminal antecedent .

If it is so , considering the facts and circumstances of the case,

in the event of his arrest or surrender before the court below within four weeks, let the petitioner abovenamed be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Case No. C2A-24 of 2003, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with
