The petitioner seeks bail in Agiaon Bazar P.S.Case No. 44 of 2013 which has been registered against unknown for offences under Sections 302 and 394/34 of the Indian Penal Code and 25(1-B) a, 26,27 and 35 of the Arms Act. Idols of Asth Dhatu of different deities worth Rs.50 lacs were taken away by unknown persons after killing the Mahanth. In course of investigation the idols were recovered on the basis of confessional statement of co-accused from the khalihan of the petitioner where the petitioner was found watching the idols. Submission is that the idols were not recovered from the conscious possession of the petitioner rather it was

recovered from the husk of the petitioner’s brother which was kept in his khalihan.
Considering the allegation, I am not inclined to grant bail to the petitioner. Accordingly, his prayer for bail is rejected.
