Allegedly when the miscreants were trying to take away the coil of a transformer after boarding on a tempo, villagers chased and the petitioner and co accused were caught. Further they stated the name of their associates and accordingly the recovered articles were produced. Submission at the Bar for release of the petitioner is that that the petitioner has been made victim of the circumstances. He has falsely been implicated in this case and is suffering in custody since 02/04/2014 having no criminal antecedent to which learned A.P.P. does not oppose. amount each to the satisfaction of learned C.J.M., Muzaffarpur, in Sakra P.S.Casre No. 154/2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall also remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
