The informant being the driver of a tractor proceeded towards Mansi then the accused persons gave him cold drinks and as soon as the informant took the cold drink he became unconscious and his driving license, cash of Rs. 5,000/-and tractor with tailor were taken away. Submission at the Bar for release of the petitioner is that he has no concern with the accused, there is no medical report regarding taking of intoxicated cold drink and nothing has been recovered and only on suspicion the petitioner has been named and is suffering in custody since 14/05/2014 to which learned A.P.P. opposes.
In the facts and circumstances, as stated above, let the petitioner Chano Mandal @ Chandra Kishore Mandal be released

on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria, in Khagaria (Chitragupt Nagar) P.S.Case No. 421/2012, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall also remain present on each and every date during trial and the default on two consecutive dates on his part without
any reason shall disentitle the petitioner from privilege of bail.
