The petitioner apprehends his arrest for the offences alleged under Sections 409 and 420 IPC registered in connection with Karpi P.S. Case No. 94 of 2013.

It is submitted that the petitioner being the Incharge Headmaster for certain duration has been falsely implicated as it is claimed that the entire work for the amount in question had been done and it is only because of proper accounting yet to be done that the offence has been alleged against the petitioner. In CWJC No. 12336 of 2013 the petitioner’s writ petition was

disposed of with a direction to the Collector, Arwal to consider the petitioner’s representation and to take a final decision in the matter.

Having regard to the entirety of the facts and circumstances of the case, as such, in the event of the petitioner’s arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad , in connection with Karpi P.S. Case No. 94 of 2013 subject to the conditions as laid down under Section 438 (2) Cr.P. C.
