The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 379, 385, and 504/34 of the Indian Penal Code and Section 3(i)(x) of the S.C/S.T Act registered in connection with Khagaria S.C/S.T P.S. Case No. 57 of 2013.

It is submitted that the F.I.R. has been instituted after considerable delay of five days after the alleged occurrence and that too in retaliation to the F.I.R. instituted by the petitioner no. 1 on 10.06.2013 prior to the present F.I.R.

Having regard to the entirety of the facts and circumstances of the case, as such, in the event of the petitioners’ arrest or surrender before the court below within

Case No. 57 of 2013, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
