3 08-07-2014 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 337, 338, 420, 504, 323 IPC registered in connection with Complaint Case No. 296 of 2011.

Accusation is that the complainant’s wife was operated upon for her uterus and appendicitis by the petitioner, but her condition deteriorated. It is further alleged that the petitioner is not qualified to conduct such operations and he is charged an hefty sum of Rs.40, 000/- which he has refused to return.

It is submitted that the petitioner is a student of BAMS third year and in fact the operation was conducted not by him but by Dr. Tulsi Prasad Akela, under whom the petitioner is a trainee.

Having regard to the specific nature of the accusations and the gravity of offence, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The bail petition stands dismissed.
