This is a petition for grant of regular bail for offence under Sections 395 and 412 of the Penal Code.

Earlier the prayer for bail of the petitioner has been rejected in Cr. Misc. No. 49418 of 2013 on 15.04.2014.

It is alleged that this petitioner was himself going with the money, belonged to Maruti Mediteck Private Limited, was looted and the petitioner is the employee of Maruti Mediteck Private Limited was going with Rs.17,50,000/-. However, the only material against the petitioner is the confession of the petitioner and part of the money recovered. The co-accused, Kundan Kumar, who has been granted bail in Cr. Misc. No. 36658 of 2014 on 03.09.2014, named this petitioner in his confession. The learned counsel for the petitioner, however, submits that the only material against the petitioner is the confessional statement of the petitioner. It is submitted that it was the petitioner, who has disclosed about the occurrence and except confession there is nothing against the petitioner and the petitioner is in jail since 05.07.2013 and has no criminal antecedent and except this case

there is no case against the petitioner.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/(rupees ten thousand) with two sureties of the like amount each in connection with Kotwali P.S. Case No. 364 of 2013 G.R. No. 3820 of 2013 to the satisfaction of the Chief Judicial Magistrate, Patna, subject to the condition that one of the bailors shall be close relative of the petitioner, who will file affidavit to the effect that the petitioner has no criminal antecedent and except this case, no case is pending against the petitioner and if any other case is pending against the petitioner, then, the bail bond shall be cancelled by the Court below, itself.
