ORAL ORDER
2 22-09-2014 Heard both the sides.
The prosecution story is that under the allurement of
obtaining engagement as Anganbari Sevika, for the prosecutrix,
the present petitioner extorted money and had established physical
contact with the lady and sexually exploited her on many
occasions.
Submission is that the lady is in the habit of filing
frivolous prosecutions under the same or similar facts against
various persons so as to extorting money and it was one of the
cases in that chain of cases. Submission was that it may not be a
case of rape, even if the facts alleged are accepted to be true on
their face value as the lady being adult was not raising any
objection to her sexual exploitation by the petitioner.
Regard being had to the facts and circumstances of the
Patna High Court Cr.Misc. No.31927 of 2014 (2) dt.22-09-2014
case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Bettiah in connection with Inarwa P.S.Case No.32 of 2014.
