The petitioner appears absenting and not making appropriate pairvi before the trial court, i.e., Ad hoc Additional Sessions Judge-III, Khagaria in Sessions Case No. 376 of 2008. Lastly, the court was forced to cancel the bonds of the petitioner on the 3rd of October, 2013.
It appears that in pursuance to the warrant of arrest issued against the petitioner, he made a prayer before the court below through his counsel that in fact he was in custody in connection with Gogri P.S. Case No. 146 of 2013 and further prayed that he be produced through a production warrant and accordingly, the petitioner was produced and remanded in the above noted sessions case on 16.04.2014. prayer for bail but that has been dismissed and this is how the petitioner has approached this Court through the present petition. Let the learned trial Judge release the petitioner on bail on execution of a bond to his own satisfaction if he has framed charges. In case there could be other accused persons who are also evading the court proceedings then the court below should ensure that either those evading accused persons are brought before him in a fortnight or that this petitioner, namely, Dinesh Muni is released on bail as directed above, even if charges could not be framed in want of appearance of other accused.
With the above directions to the court below, this
petition stands disposed of.
