The petitioner seeks bail in Vaishali Town P.S. Case No. 270 of 2014 instituted under Sections 376, 511/34 of the Indian Penal Code.

Allegedly, four persons were trying to outrage the modesty of a mentally-ill lady, who was staying in Sadar Hospital, Hajipur, and out of them, the name of the petitioner transpired.

Submission at the Bar for release of the petitioner is that no one has named the petitioner but only due to dirty politics, he has been implicated in this case. From bare perusal of the F.I.R., no offence is made out against the petitioner and, as such, he deserves sympathetic consideration, to which learned A.P.P. does not oppose.

In the facts and circumstances of the case, as stated above, the petitioner, namely, Manoj Kumar is directed to be released on bail on executing bail bonds in the sum of Rs. 10,000/(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Vaishali Town P.S. Case No. 270 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle him from the privilege of bail.
