The petitioner seeks bail in Matihani P.S. Case No. 17 of 2014 instituted under Sections 406, 420/34 of the Indian Penal Code.

The petitioner, being a driver of the tractor of the informant, made the tractor traceless and thereafter when the petitioner was negotiating to sell the same, in the meantime, local people assembled there and assaulted the petitioner and then the petitioner was brought to Matihani Police Station in an injured condition.

Submissions at the Bar for release of the petitioner are that, as a matter of fact, the petitioner was not the driver, rather he was a labourer and there was some dues of wages resulting in

implication of the petitioner in this false case. He has got no criminal antecedent and is suffering in custody since 17.02.2014. Learned A.P.P. for the State opposes the prayer for

In the facts and circumstances of the case, as stated above, and considering the period of custody of the petitioner, at this stage the petitioner, namely, Krishna Paswan is directed to be released on bail on executing bail bonds in the sum of Rs. 10,000/(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in Matihani P.S. Case No. 17 of 2014 dated 16.02.2014 corresponding to G.R. No. 817 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle him from the privilege of bail.
