Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.
It is contended that the case was registered against ten unknown accused persons. In course of investigation name of the petitioner transpired on the basis of confessional statement of coaccused. He was remanded to judicial custody on 11th September, 2013 and since then he has not been put on T.I.Parade. It is further contended that nothing incriminating was ever recovered from possession of the petitioner and he has no criminal antecedent.
Considering the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Mehsi P.S. Case No.139 of 20013.
