The petitioner seeks bail in connection with Khagaul P.S. Case No.46 of 2014 registered for the offences punishable under sections 419 and 420 read with 34 of the Indian Penal Code.
It has been contended that the ingredients of the offence punishable under section 420 of the Indian Penal Code would not be attracted in the facts and circumstances of the present case. At best, it would be a case under section 419 read with 511 of the Indian Penal Code. The petitioner is said to be in custody since 12th March, 2014 and has no criminal antecedent.
Learned counsel for the State has opposed the prayer for bail.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on
