2 20-08-2014 Heard learned counsel for the petitioners and the State. The petitioners seek regular bail in a case registered for the offence punishable under Sections 25 (1-b)a, 26, 27 and 35 of the Arms Act.

Allegedly from the possession of petitioner no.1, one live cartridge has been recovered whereas from the possession of petitioner no.2 one country made pistol with one cartridge has been recovered.

Submission at the Bar for release of the petitioners is that both are suffering in custody since 18/03/2014.

bail, after framing of charge , on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in Falka(Pothiya)P.S.Case No. 63 of 2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
