2 20-08-2014 Heard learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Kanti P.S. Case No. 306 of 2013 registered for the offences punishable under Sections 341, 342, 323, 307, 379, 376 (G)/34 of the Indian Penal Code.

The petitioner is not named in the FIR and his name transpired in the confessional statement of co-accused Ranjit Kumar Prasad. The allegation is that 3 named and 3 unknown persons committed rape forcibly on the victim/informant.

Submission at the bar for release of the petitioner is that there is no test identification parade, up till now besides the confessional statement nothing has come against the petitioner and

as such the petitioner having no criminal antecedent deserves sympathetic consideration.

In the facts and circumstances as stated above and noticing that the victim/informant has neither named the petitioner nor the petitioner has been put on test identification parade up till now, the petitioner Rajeev Kumar is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3^rd Adhoc Additional Sessions Judge, Muzaffarpur in Sessions Trial No. 797 of 2013 arising out of Kanti P.S. Case No. 306 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
