Allegedly, informant’s son Abhay Kumar had gone for a walk in the Tola of his Fufa, thereafter, he did not return. On the next morning his dead body was found lying on the road with firearm injury. The informant raised suspicion against the petitioner also.

case co-accused Santosh Kumar and Ashok Kumar Amar have already been allowed bail by another Bench of this Court vide Cr. Misc. Nos. 47577 of 2012 and 37419 of 2013 respectively and the petitioner is suffering in custody since 15.3.2014.

In the facts and circumstances as stated above and noticing the case of the petitioner is on similar footing of those accused who have already been allowed bail, the petitioner Anil Yadav is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 123 of 2012, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
