The petitioner seeks bail in connection with Govindganj P.S. Case No. 225 of 2013 registered for the offences punishable under Section 414 of the Indian Penal Code and Sections 25(1-B)A, 26/35 of the Arms Act.

During search, from possession of the petitioner, one loaded country made Katta and besides four live cartridges one black colour mobile were recovered and for that recovery the petitioner is in custody since 8.10.2013 and the petitioner has no criminal antecedent.

In the facts and circumstances as stated above, the petitioner Awadh Sah @ Awadhesh Sah is directed to be released

on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sadar Motihari, East Champaran in connection with Govindganj P.S. Case No. 225 of 2013, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
