The two petitioners seek anticipatory bail in a case registered for the offence under Sections 341, 323, 325, 307, 504 read with Section 34 of the Indian Penal Code wherein the allegation against petitioner no. 1, namely, Ranjeet Mahtho @ Ramjeevan Prasad @ Ramjee Mahto is of assaulting the informant by iron fitted lathi on his head, leading to injuries on his head. It is further alleged that thereafter, petitioner no. 2, namely, Sujeet Kumar and one another also assaulted him. The petitioners happen to be the co-villagers and the informant has not stated any reason why he was assaulted by the petitioners, especially, petitioner no. 1, who is

stated to be a septuagenarian. Injury report, annexed as Annexure -3 to the petition, discloses that three injuries were received by the informant, out of which, one is on his head. However, the nature of injury has been stated to be simple.

Considering the fact that petitioner no. 1 is a person of old age and no motive has been ascribed for assaulting the informant, let both the petitioners above named, in the event of their arrest or surrender within four week from the date of receipt of the order in the court below, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Ninchak Bathan P.S. Case No. 114 of 2013 to the satisfaction of Chief Judicial Magistrate, Gaya subject to the conditions as laid down u/S 438 (2) of the Code of Criminal Procedure.
