The petitioner is accused in a case registered for the offence under Section 420 read with Section 34 of the Indian Penal Code.

The allegation against the petitioner in the complaint petition is that he, being a commission agent, has introduced the complainant and a sum, which had to be delivered, was never delivered.

The defence of the petitioner is that he is neither the commission agent nor he has introduced with any other company

and he is not required to do anything. He has only recommended the name of the complainant.

Considering the nature of the offence and the fact that

he has clean antecedents, let the petitioner above named, in the event of their arrest or surrender within four week from the date of receipt of the order in the court below, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Complaint Case No. 2218 of 2012 to the satisfaction of Judicial Magistrate, Ist Class, Samastipur subject to the conditions as laid down u/S 438 (2) of the Code of Criminal Procedure.
