happens to be the petitioner commonly originate out of Alauli P.S. Case No.220 of 2013 and on account thereof, there has been analogous hearing and are being disposed of by a common order.

Deceased Sukhdeo Ram while was coming along with informant Bhago Devi, Runa Devi, Sita Ram Sao from Block Office, Alauli, were intercepted by the persons named therein including Lalo Yadav and during course thereof they entered into dual with Sukhdeo Ram as he was making necessary pairvi on behalf of informant in a land dispute and during course thereof, Jaijai Yadav shot at Sukhdeo followed by another shot by Rajo Yadav and the third one by one Sharma.

It has been submitted on behalf of petitioner Lalo Yadav that he is not an assailant and in the aforesaid background others have already been granted bail vide Cr. Misc. Nos.50305 of 2013, 53051 of 2013, 10883 of 2014, 20434 of 2014.

It has also been submitted on behalf of petitioner Bino Sada that he is not named in the FIR. During course of further investigation his name had purposely been introduced after more than two months of the occurrence without having specific allegation.

On the other hand, the learned Additional Public Prosecutor opposed the prayer and submitted that from the nature of occurrence it is apparent that two different fiction have clashed resulting death of Sukhdeo Ram.

Accordingly, petitioners (1) Lalo Yadav , son of Late Triveni Yadav of village Gourachack, P.S.-Alauli, DistrictKharia and (2) Bino Sada are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alouli P.S. Case No.220 of 2013.
