As prayed, the anticipatory bail application as against petitioner no. 1 namely, Md. Ali Hussain is permitted to be withdrawn and is dismissed as such.

The petitioner no. 2 apprehends her arrest for the offences alleged under Sections 120(B), 420 IPC registered in connection with Complaint Case No. 10 of 2013, Trial No. 3930 of 2014.

It is submitted that the transaction in question is in any event in the nature of a pure civil dispute. Similarly situated co-accused Budhu Mian has been granted anticipatory bail by this Court in Cr. Misc. No. 20751 of 2014.

Having regard to the entirety of the facts and circumstances of the case, in the event of arrest or surrender by petitioner no. 2 before the court below within six weeks from the date of communication of this order, let the above named petitioner no. 2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri Santosh Kumar, learned Judicial Magistrate Ist Class, Muzaffarpur, in connection with Complaint Case No. 10 of 2013, Trial No. 3930 of 2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
