It is submitted on behalf of the petitioner that 75 Kg. of rice meant for Mid Day Meal Programme was recovered from the house of co accused, Rajesh Kumar Choudhary, who disclosed that the same was given to him by the petitioner, who is a teacher.

As the name of the petitioner has come in the statement of co accused and there is no recovery from the possession of the petitioner and further considering his detention, now petitioner, Devendra Kumar @ Devendra Yadav, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the

satisfaction of Shri Mukesh Kumar, Judicial Magistrate, Supaul in Kishanpur P.S.Case No. 58/2014, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
