The petitioner apprehends his arrest for the offences alleged under Section 406 IPC registered in connection with Complaint Case No. 517C of 2013.

It is submitted that the accusations in the complaint at best disclose a dispute with regard to nonrefund of loan and thus in nature of civil dispute. The complaint itself appears to have been filed after inordinate delay on 03.04.2013 for the alleged occurrence on 20.03.2010 when the money was allegedly promised to be returned.

Having regard to the entirety of the facts and circumstances of the case, as such, in the event of the petitioner’s arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Complaint Case No. 517C of 2013, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
