In an attempt to commit rape, petitioner threw the victim on the ground and lifted ‘Sari’ upto knee and for that on the written report of victim, instant case has been registered.
It has been contended on behalf of petitioner that
the occurrence has been alleged in exaggerated and twisted form at the behest of enemies of petitioner, otherwise during course of investigation the I.O. had collected material that both the parties locked their horns followed with scuffle as well as push and pool. It has further been submitted that petitioner happens to be under custody since 28.12.2013. It has also been submitted that petitioner at an earlier occasion was victimized in similar way which ended in acquittal on account of compromise.

On the other hand, learned Additional Public Prosecutor opposed the prayer.
In the aforesaid facts and circumstances of the case, petitioner Rohit Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Muffasil P. S. Case no.220 of 2013, subject to condition that future involvement of petitioner in such kind of cases will deprive him from enjoying the privilege of bail.
