2 19-02-2014 Heard learned counsel for the petitioners and learned counsel representing the State. The petitioners are in custody since 7.9.2013 in a case registered against unknown under sections 457 and 380 of the Indian Penal Code.

Uncontroverted submission is that co-accused Bittu Rai under identical circumstance has been admitted to bail by this Court in Cr. Misc. No. 54111 of 2013. Further submission is that no one has seen the occurrence. The petitioner is not named in the FIR and has not been put on test identification parade.

Considering the facts and circumstances of the case, the petitioners above named are directed to be released on
