The case relates to murder of three persons. The FIR has been registered against unknown for offences under Section 302/34 of the Indian Penal Code and 27 of the Arms Act. The informant could not state as to who was the shooter. It was suspected that the killing was on account of enmity.
Submission is that the occurrence was not witnessed by the informant and his persons and that was the reason nonnaming of any of the accused. Further submission is that coaccused Upendra Yadav alias Gora Yadav alias Genda Yadav has been admitted to bail on 13.03.2012 in Cr.Misc.No. 7668 of 2013. There is no specific allegation against the petitioner.
Considering the facts and circumstances of the
