The petitioner prays for grant of bail in connection with Barauni P.S. Case No. 159 of 2014 registered for the offence under Sections 342, 323, 354(B) of the Indian Penal Code. Allegedly, the petitioner after catching the daughter of the informant took away in bringal field and after pressing her mouth tried to outrage her modesty but due to alarm being raised the petitioner was caught and she was saved. Submission at the bar for release of the petitioner is that some of the witnesses during investigation have stated that the victim and the petitioner both are known to each other since long and the victim girl was seen talking with the petitioner, the victim

girl was major one, there was only altercation resulting this false case and the petitioner is suffering in custody since 19.03.2014 having no criminal antecedent.
The learned Additional Public Prosecutor opposes the prayer of bail.
In the facts and circumstances as stated above and noticing the statements of some of the witnesses as above, the allegation attributed, detention of the petitioner at this stage, the petitioner, Deepak Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 159 of 2014 with conditions that one of the bailors must be near relative and the other having sufficient immovable property within the jurisdiction of the trial court and further the petitioner shall remain present during the trial on each and every date and two consecutive defaults without any reasonable cause shall disentitle him from the privilege of bail.
