The petitioner prays for grant of bail in connection with Sonepur P.S. Case No. 276 of 2013 registered for the offence under Section 366A/34 of the Indian Penal Code.

Allegedly, 17 years aged daughter of the informant was kidnapped and it is alleged that co-accused Gunjan Singh being Bhagin Damad of the informant with the help of Rustam Miyan has kidnapped her, during investigation the victim girl was recovered with co-accused Gunjan Singh and in 161 Cr.P.C. statement she has named the petitioner also as an associate of Gunjan Singh and in 164 Cr.P.C. statement she

has stated that the petitioner closed her eyes with the cloth.

Submission at the bar for release of the petitioner is that Gunjan Singh has already been allowed bail and the petitioner with allegation to have assisted him is suffering in custody since 23.01.2014 having one criminal antecedent.

The learned Additional Public Prosecutor opposes the prayer of bail by referring the statement recorded under Section 164 Cr.P.C.

Considering that the victim girl was recovered in the company of co-accused, Gunjan Singh and he has already been allowed bail by the court below itself and in the statement recorded under Section 164 Cr.P.C. also there is no allegation of committing sexual assault, the petitioner, Vikash Kumar @ Vikash Kumar Singh is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Sonepur P.S. Case No. 276 of 2013 with conditions that one of the bailors must be near relative and the other having sufficient immovable property within the jurisdiction of the trial court and further the petitioner shall remain present during the trial on each and every date and two
