The petitioner seeks bail in a case which has been registered under Sections 387, 302/34 of the Indian Penal Code and Section 27 of the Arms Act in connection with Barahiya P.S. Case No. 155 of 2013. Allegedly for non-fulfilling the ransom amount of Rs. 20 lakhs which was being demanded on mobile, the coaccused and the petitioner came in Tata Magic vehicle called the son of the informant and killed him by shooting at his chest and again caused threat to kill for non-fulfilling the ransom amount. Submission is that the informant in his further statement has specifically stated that co-accused Om Jha called the

son of the informant and shot him and the petitioner was only sitting in Tata Magic vehicle to which the learned APP seriously opposes by submitting that with common intention ransom was demanded and for non-fulfilling the son of the informant was killed and again threat was caused.
Considering the submissions urged at the Bar, going through the FIR, impugned order and noticing that for nonfulfilling the demand of ransom co-accused and the petitioner went at the shop of the informant called the son of the informant and killed him and as such this Court is not inclined to enlarge the above named petitioner on bail and accordingly his prayer for bail stands rejected at this stage.
