The petitioners apprehend their arrest for the offences alleged under Sections 409, 420, 467, 468, 471, 477, 120(B)/34 of the Indian Penal Code read with 13 (2), and 13 (1) (D) of the P.C. Act registered in connection with Vigilance Patna P.S. Case No. 03 of 2013.

It is submitted that the petitioners had been granted anticipatory bail in Cr. Misc. No. 16252 of 2011 in relation to Karja P.S. Case No. 22 of 2011 and it is on the same facts that once again the present Vigilance Patna P.S.

Case No. 03 of 2013 has been filed. It is further submitted that despite further lapse of time no charge-sheet has yet been submitted in the aforesaid Karja P.S. Case No. 22 of 2011.

Heard learned Assistant Counsel for the Vigilance who opposes the prayer for bail but however unable to controvert the submissions of the petitioners.

Having regard to the entirety of the facts and circumstances of the case, as such, in the event of the petitioners’ arrest or surrender before the court below within six weeks from the date of communication of this order, let the above named petitioners be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned Special Judge, Vigilance, North Bihar Muzaffarpur, in connection with Vigilance Patna P.S. Case No. 03 of 2013 (Spl. Case No. 03 of 2013), subject to the conditions as laid down under Section 438 (2) Cr.P.C.
