Karpuri Thakur and his wife are the petitioners of the case which has been registered under Sections 307, 302 and some other Sections of the Indian Penal Code.

The informant Ranjit Kumar Thakur in his fardbeyan

given at police station alleged that the petitioner and two others having Lathi, Rod and Khanti came and started assaulting indiscriminately Dinesh Thakur. Sanjay Thakur and Sima Devi came for rescue but they were also assaulted. The injured was being taken to Muzaffarpur for treatment but in the way he succumbed to his injuries.

Submission is that there is case and counter case. The

injuries were on the side of the petitioners also. There is no explanation of the injuries of the petitioners. There is no specific allegation against any of the accused. The case will not come under Section 302 of the Indian Penal Code. It has also been submitted that both the sides are of one family and the petitioners have no criminal antecedent.

Considering the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/court concerned, Muzaffarpur in connection with Sakra P.S. Case No. 335 of 2013.
