The present application has been filed for quashing the order dated 09.11.2012 passed by the learned C.J.M., Samastipur, in Warisnagar P.S. Case No. 165 of 2012 whereby the processes were directed to be issued after cognizance being taken for the offences punishable under Sections 452, 341, 323, 307 and 379/34 of the I.P.C. It is submitted by learned senior counsel for the petitioner that the petitioner was not sent up for trial but the impugned order does not reflect that the petitioner was not sent up for trial and differing with the final form cognizance has been taken against the petitioner. This Court finds substance in submission of learned senior counsel for the petitioner. The application is disposed off with liberty
