The petitioner seeks bail in Maner P.S. Case No. 441 of 2013 dated 24.11.2013 instituted under Sections 302/120B of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioner submits that though he is not named in the F.I.R. but the allegation is that the two sons of the informant had gone to the mobile shop and when the informant went to look for them the shop was closed and next

morning their dead bodies were found. It is also alleged that Sohrai Rai, who was the neighbour of the informant with whom there was dispute, and his sons had given threatening to the informant and further that the petitioner who is the brother-in-law (sala) of the son of the Sohrai Rai namely, Arun Kumar had purchased mobile from the shop of the informant’s son and was not paying for the same. Learned counsel submits that there are no eye witnesses and even the motive as mentioned in the F.I.R. is too frivolous and also that the petitioner lives in a different village. It is submitted that the petitioner has clean antecedent and is in custody since 25.11.2013.
Considering the facts and circumstances of the case and submissions of learned counsels for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, Patna in Maner P.S. Case No. 441 of 2013. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to do so on two consecutive dates, without sufficient cause, shall lead to cancellation of his bail bonds.
