3. 14.07.2014 Heard learned counsel for the petitioner and Learned A.P.P. for the State.
The petitioner seeks bail in Singhia P.S. Case No. 92 of 2013 dated 30.08.2013 instituted for offence punishable under Sections 120B/323/364/379/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that he is not named in the F.I.R. and that one of the named accused against whom suspicion has been raised, Dayanand Yadav, has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 52131 of 2013 on 03.02.2014, copy of the same is at Annexure-2. It is submitted that on the confessional statement,
the petitioner has been implicated without there being any recovery from his conscious possession. It is further submitted

that the petitioner has no criminal antecedent and in custody since 30.09.2013. It is submitted that there has been no Test Identification Parade.
Considering the facts and circumstances of the case and submissions of learned counsels for the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Rosera at Samastipur in Singhia P.S. Case No. 92 of 2013. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to do so on two consecutive dates, without sufficient cause, shall lead to cancellation of his bail bonds.
