The petitioner seeks bail in Bikram P.S. Case No. 195 of 2013 dated 26.07.2013 instituted for offence punishable under Sections 302/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though he is named along with three others, all family members as persons who have assaulted the father of the deceased but the allegation is general and omnibus of assault by ‘Lathi’ and ‘Danda’. It is submitted that during investigation it has come that the deceased was 85 years old and due to difference between the families with regard to a drain, the deceased who is the father of the informant had come to settle the matter where

he slipped and fell down, leading to his death. It is submitted that the post mortem report also shows that there is lacerated wound. It is further submitted that the petitioner is in custody since 04.12.2013.
Considering the facts and circumstances of the case and submissions of learned counsels for the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, District- Patna in Bikram P.S. Case No. 195 of 2013. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to do so on two consecutive dates, without sufficient cause, shall lead to cancellation of his bail bonds.
