2 15-05-2014 Heard learned counsel for the petitioners and learned counsel for the informant as well as learned counsel for the State. The petitioners have been arrested in connection with Khagaria P.S. Case No. 612 of 2012, G.R. No. 2285 of 2012, registered under Sections 147, 148, 149, 341, 342, 323, 325, 307, 379 and 363 of the Indian Penal Code as well as 27 of the Arms Act.

There is specific allegation against co-accused, namely, Jai Kishore Rai who shot fire causing injury to one Chandan Kumar. However, there is general and omnibus allegation that 36 persons named in the First Information Report armed with lathi, danda came and assaulted the informant.

Learned counsel for the petitioners submits that several persons have been granted anticipatory bail and the case of the petitioners is on similar footing.

petitioners have criminal antecedent and eight cases were pending against them.

Having regard to the facts and circumstances of the case, the above named petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Muffasil) P.S. Case No. 612of 2012 corresponding to G.R. No. 2285 of 2012, subject to condition that petitioners will not indulge in such activity in future. Further condition that one of the bailors shall be near relative of the petitioners who will file an affidavit to this effect that petitioners shall not indulge in such activity in future. Further condition that if any case reported against these petitioners then trial court shall consider the cancellation of bail bonds of the petitioners.
