This is second attempt on behalf of the petitioner, whose prayer was earlier refused vide order dated 11.01.2013 passed in Cr. Misc. No. 40539 of 2012 in connection with Bhagwanpur P.S. Case No. 60 of 2012 pending before Chief Judicial Magistrate, Begusarai, with a liberty to renew the prayer before the trial court itself after one and half year of his detention, which petitioner has unsuccessfully availed. Further, as submitted, petitioner carries no criminal antecedent . If it is so , having regard to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - Ist, Begusarai, in connection with Sessions Trial No. 461 of 2013 arising out of Bhagwanpur P.S. Case No. 60 of 2012, subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
