Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner, apprehends his arrest in connection with a case registered for the offence punishable under Sections 406, 409 and 420 of the Indian Penal Code, is solitary named accused with allegation of entrustment of substantial quantity of rice for milling, he could discharge his responsibility up to 80% but with respect to 20% under particular circumstances he was compelled to sell and deposit Rs. 5 lacs and odds. In spite of that certificate case has been initiated for 18.9 lacs and odds. To avoid future complications petitioner is ready and willing to deposit 1/3^rd amount as claimed, subject to result of the case.

Having regard to the facts and circumstances of the case, in the event of filing and application stating all such intention as stated above and deposit of the amount so offered within eight

weeks, in the event of his arrest/surrender before the court below within eight weeks , let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in connection with Jamhore P.S. Case No. 61/2013 , subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure with additional condition to remain physically present before the court below on each and every date at least for two years or till disposal of the case, whichever is earlier and in case of failure on two consecutive dates or violation of undertaking, without giving any reasonable explanation, the liberty granted shall be deemed to be cancelled.
