4 13-12-2013 This matter is running on the list since last many weeks and was called out also. However, learned counsel did not appear to assist this Court and today also he is not present to press this application.
A counter affidavit has been filed by the Insurance Company and learned counsel submits that life insured had died in 1986 and long time before filing of this writ application. The Company has never received any application from the petitioner for release of insured amount. He submits that the Insurance Company does not have any paper at this stage to consider the claim of the petitioner. However, an offer has been made in the counter affidavit, as well as by learned counsel for the Insurance Company, that if the petitioner produces unimpeachable

documents with regard to insurance policy as mentioned in paragraph 13 of the counter affidavit, the Insurance Company is still open to consider the said claim.
However, since learned counsel for the petitioner is not present to press this application, the same is dismissed as not pressed.
