4 19-11-2013 Petitioner has filed this writ application for a direction to the respondents to pay its admitted dues.

As per the case of petitioner, under the valid work orders, it executed the work in terms of the contract agreement and completed the same to the satisfaction of the respondents.

A counter affidavit has been filed in which it is stated that substantial amount of the bill of petitioner has been paid. However, there is no denial in the counter affidavit in respect of entitlement of the petitioner for rest amount of the bill.

In the circumstances, this writ application is disposed of with a direction to the respondent-Executive Engineer, Sikrahana,

Tatbandh Division, Motihari to take up the bill of petitioner in respect of rest amount of the bill and pay the same within two months from the date of receipt/production of a copy of this order failing which he shall pay interest @ 12% per annum on the remaining amount of the bill from his own pocket.

It goes without saying that in case rest amount of bill of the petitioner is disputed or denied, a specific reasoned order shall be passed in that respect and shall be communicated to the petitioner within that very period.
