5 19-11-2013 When this case was called out on 28.06.2012 and again on 09.08.2012, none had appeared for the petitioner. In the last week, this matter was called out and the same was passed over on account of non-appearance of learned counsel for the petitioner. Today also, he is not present in Court.

This writ application has been filed for a direction to the respondents to pay the outstanding dues of the petitioner.

As per the case of petitioner, under valid agreement, he executed some works to the satisfaction of the respondents. Thereafter he submitted his bills. His grievance is that bills have

not been processed as yet and admitted amount of the bills has not been paid to him.

In the circumstances, this writ application is disposed of with a direction to respondent no.4, Chief Engineer, Road Construction Department, South Bihar, Patna to see to it that bills of the petitioner are processed and admitted amount is paid to him positively within two months from the date of receipt/production of a copy of this order, failing which the said amount shall carry on 12% interest per annum on the amount which shall be paid by respondent no.4 from his own pocket. It goes without saying that if any part of the bills is disputed or any claim of petitioner of the said amount is denied, a specific reasoned order shall be passed in accordance with law and the same shall be communicated to the petitioner within that very period.
