Learned counsel, after some argument, seeks permission to withdrawn this application so as to raise his contention, before the Court below at any stage, that a counter claim by a defendant cannot be maintained successfully against defendants as the

counter claim is always against the plaintiff.
This application is permitted to be withdrawn. The petitioner shall have the liberty to raise all the submissions as regards maintainability of the counter claim as have been raised in the present application, before the Court below at appropriate stage which shall be considered in accordance with law.
This application is disposed of accordingly.
