6 04-09-2013 Heard the learned counsel for the petitioner and learned APP for the State.

The petitioners apprehends their arrest for the alleged offences under Sections 498A,323,504 and 3/4 D.P.Act registered in connection with Complaint Case No. 31 of 2012 of the Indian penal Code.

It is submitted that allegation is with regard to demand of dowry and torture for non fulfillment of dowry. The petitioners have been falsely implicated in this case and the entire story is concocted.

Petitioner no. 1 who is the husband states that he is ready to keep opposite party no. 2 with full dignity and honour. Petitioner nos. 2, 3and 4 are the father-in-law, son-in-law and daughter-in-law of opposite party no. 2.

Despite valid service of notice being served on opposite party no. 2, none appeared on her behalf when the case is called out on 21.8.2013 and even today.

In that view of the matter, the provisional bail granted to the petitioners in terms of order dated 08.02.2013 to the satisfaction of Sub Divisional Judicial Magistrate, Aurangabad in connection with Complaint Case no. 31 of 2012 stands confirmed.

Cr. Misc. No.5670 of 2013 stands disposed of.
