JUSTICE VIKASH JAIN ORAL ORDER 4 04-09-2013 Heard the learned counsel for the petitioner and learned APP for the State. 2. The petitioner apprehends his arrest for the alleged offences under Sections 498A, and 3/4 of the D.P.Act registered in connection with Complaint Case No. 3300 of 2012 of the Indian penal Code. 3. The allegation is with regard to demand of dowry and torture for non fulfillment thereof. 4. It is submitted that the petitioner has been falsely implicated in this case. A statement is made at the bar that the petitioner is ready to keep his wife with full dignity and honour, rather it is the complainant who does not want to reside with her husband.

- Despite valid service of notice and having entered appearance, none was present on behalf of the opposite party no. 2 when the case was called out on 21.08.2013 nor even today.
In the above view of the matter, the provisional bail granted to the petitioner in terms of order dated 22.03.2013 to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Complaint Case no.3300 of 2012, stands confirmed.
