2. This petition for anticipatory bail has been filed on behalf of the petitioner who apprehends her arrest for the offences alleged under Sections 498 (A), 323, 504, 506 and 494 of the I.P.C.

3. The complainant claims to be the first wife of Lal Keshar Sharma, and alleges that the petitioner herein is his second wife.

Learned counsel for the petitioner submits that she has been implicated in this case without due application of mind considering that the provisions of 498 (A) and 494 I.P.C. are not at all applicable to her. Apart from the bald statement that she is the second wife, no offence is attributed to her. It is also pointed out that the complaint petition was filed over a decade ago on 21.11.2000 and it is only recently that

summons have been issued to the petitioner.

Considering the above facts, in the event of arrest or surrender before the court below within 12 weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Nawada, in connection with Complaint Case No. 1000/2000, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
