JUSTICE AKHILESH CHANDRA ORAL ORDER 6 03-04-2013 Heard Mr. Dhananjay Kumar Singh, learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is second attempt on behalf of the petitioner whose prayer was earlier refused vide order dated 16.05.2012 passed in Cr. Misc. No. 14302 of 2012 with a direction to the court below to proceed expeditiously with the trial since it was expecting the conclusion of the trial within six months, but as is evident from the recent report that the progress is not satisfactory and petitioner is languishing in custody with allegation of keeping about 8 Kg. of Ganja. Further, as submitted, the petitioner also carries no criminal antecedent . If it is so , having regard to the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Special Judge – XI, Patna, in connection with Patna Railway Thana Case No. 458 of 2010 (Special Case No. 42 of 2010) , subject to condition to remain physically present before the court below on each and every date till disposal of the case and in case of failure on two consecutive dates without giving any reasonable explanation, the privilege granted shall be deemed to be cancelled.
