The petitioner seeks bail in a case registered under Section 307 and some other sections of the Indian Penal Code, section 27 of the Arms Act and Sections 3 (i) (x) of the Prevention of Atrocities on SC/ST Act. Though other accused persons are there but the allegation of firing is against the petitioner. Relying upon annexure-3, learned counsel for the petitioner argued that injury was found to be simple. There were no intervening circumstances, so section 307 Indian Penal Code is not made out. There is case and counter case. It was a case of free fight between two sides.
