This is a petition for grant of regular bail for offence under Section 392 of the Penal Code.

The first information report is against unknown

persons.

The learned counsel for the State, however, submits that in paragraphs 43, 44, 45 and 46 of the case diary there is indication of the occurrence and, further, in paragraph 52 of the case diary there is report of the spy about the description of the of the accused. The learned counsel for the petitioner submits that there is no specific allegation against the petitioner and the petitioner has neither been named nor identified nor any recover has been from his possession.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Agam Kuan P.S. Case No. 78 of 2012 to the satisfaction of Additional Chief Judicial Magistrate, Patna City.
